Indian Railways Aim to be Atmanirbhar, a Great Opportunity for MSMEs

Indian Railways Aim to be Atmanirbhar, a Great Opportunity for MSMEs

The government of India, under the leadership of Shri Narendra Modi, is working towards making India Atmanirbhar. As part of its steps towards this, Indian Railways has decided to invite MSMEs to become partners. It will be the first of its kind in history that allows small industries to cater to the needs of the third-largest railway network in the world.

The Indian Rail is looking towards contributors who can build coaches and engines and provide material for the management and maintenance of its properties. According to the reports, the railways will be buying goods of over Rs. 70,000 crores annually. So, this will be a good opportunity for MSMEs to acquire long-term contracts and ensure steady growth while the government is promoting Atmanirbhar Bharat Abhiyan.

The government will ensure a specific, impartial, and transparent process of purchase to encourage the involvement of small industries. It includes;

Make In India Policy

Under the Make In India policy, the government is encouraging the local production of raw materials and finished products for industrial and domestic use in the country.

As long as the rail components and parts are concerned, only those suppliers are eligible to apply who are using at least 50% locally produced raw material. It includes the supply of the goods to be used for manufacturing wagons, tracks, and LHB coaches.

Same way, 75% of the electronic components for Vande Bharat trains will have to be made in India.

Priority to MSMEs

The authorities have decided to give priority to MSMEs while selecting bids. The purpose is to encourage small entrepreneurs to come ahead and work with the government sectors. Further, it will also help small industries achieve sustainable growth by eliminating or reducing the fear of competition from large companies.

Under this policy, the government will choose the MSME with the lowest bid. In case the lowest bid is not from an MSME, priority will be given to an MSME whose bid is higher by up to 15%.

Increasing Ease of Doing Business

To encourage people to become entrepreneurs and create employment, the government has taken several concrete actions for making business easy. One of them is exemptions from earnest money deposits and security deposits for MSMEs.

Another relief is, there is no more need for new authorization from the Indian Rail. An authorized vendor for a good or category goods will be considered as authorized by the railway to supply any goods.

Those looking for more information on the list of annual requirements and tenders may visit and MSMEs can also register themself as vendors on these websites.

So, if you are an entrepreneur having a micro, small, or medium enterprise, you can be a partner of the Indian rail in the journey of development. Visit the links given above and check if you can contribute.

Lockdown in India: Outcomes Achieved and Challenges to Overcome

Lockdown in India: Outcomes Achieved and Challenges to Overcome

The world is at the edge of a crisis and there seems no end at this time. Most of the countries are in lockdown and major economies are facing a hard time. There are more than 2 million Corona affected cases confirmed globally. If we talk about India, there are more than 12 thousand cases out of which over 1500 people have recovered from the infection. At the global level, half a million people have defeated Corona.

Keeping these stats aside, if we look at the measures being taken by countries, it’s clear that they are not uniformed. Also, countries like the USA, Spain, Italy, the UK are facing a huge challenge as they didn’t take early and expected actions. People also didn’t take Corona seriously and this worsened the situation in these countries.

Where does India stand in comparison to the world?

As long as India is concerned, the situation seems under control so far as a result of the lockdown phase-1. But the numbers are really disturbing and posing questions if we are taking every necessary step to stop Coronavirus from spreading in the country?

See the number of cases, recovered cases and the number of tests being done per 1 million population in India compared to other countries.

Lockdown in India: Outcomes Achieved and Challenges to Overcome

Date: 16-Apr-2020

Looking at these statistics, it’s quite clear that India is doing far fewer tests per 1M population. However, it can be said that India has done far more tests than in many countries. Total 274599 tests are done as on 16th April 2020. It means the government is doing good. However, the quantity of COVID19 examinations needs to be increased to get a more accurate picture of the spread of Coronavirus in India.

Essential supplies during the lockdown in India

Though lockdown is causing a huge economic loss, India has two positive factors that can’t be ignored.

1. Medicines

India has a large stock of generic medicines, especially those effective against Corona, i.e. Hydroxychloroquine. Also, the production of this medicine is on. In fact, India has supplied this medicine to countries in the USA, Brazil, and Israel among many others.

Doctors, nurses, and workers in the medical field, as well as pharma companies, have become the real heroes in this terrifying environment. All clinics and medical stores are allowed to remain opened and having enough stock of generic medicines. So there is no shortage of medical treatment or medicines for the general public so far.

2. Food

India has more than the required stock level. Normally, there should be 76 lakh tonnes of rice and 138 lakh tonnes of wheat in buffer stock as per the norm. But, as of March 2020, there are 309.76 lakh tonnes of rice and 275.21 lakh tonnes of wheat lying in the godowns of FCI.

Below are the statistics from the FCI’s official website.

Lockdown in India: Outcomes Achieved and Challenges to Overcome

Date: 16-Apr-2020

Given the stock of food and medicines, India doesn’t have to worry about feeding and providing medical treatment to the citizens during the pandemic and the lockdown. However, the supply system is yet to be improved. The news shown on media is raising questions among the people as to why still there is a shortage of food in some areas. Rationing stores in many cities are still waiting for the new stock.

Challenges for the local and central government

Despite a continuous appeal from the prime minister and other political leaders as well as local authorities, media, and celebrities, people are gathering at the shops and bazaars and roaming without specific reasons. Migrants are also a big challenge as they are trying to escape the cities.

In order to make lockdown effective, local authorities and police are being strict and punishing out-goers. They are also detaining private vehicles, issuing fines and trying many other ways to keep people in their homes. However, the success in the fight against Corona will only be achieved if each person takes responsibility, maintain social distancing, and stay home.

Migrant workers demanding food or permission to migrate

Poor people are waiting for help from the government and losing hope and patience now. A recent gathering of migrant workers outside of the Bandra station in Mumbai sadly reflects this situation. If the authorities fail to provide food and money to needy people swiftly, more such incidences may happen.

Organizations and people serving the poor and needy people

There are many non-government and Not-For-Profit organizations working tirelessly to feed hungry and underprivileged people in slums and backward areas in the country. Also, the mass migration and agitations due to the non-availability of food are considerably reduced within two weeks of lockdown phase1. Now the situation seems fairly under control in the lockdown phase-2.

Looking at the prevailing situation, it’s hard to say what will be the scenario in the coming weeks. But we can say that the government, with help of doctors, medical staff, pharma workers, scientists, government employees providing essential services, police, and citizens, will definitely get India out of this tough time.

Are Small Countries Becoming Victims of Chinese Debt-trap?

Are Small Countries Becoming Victims of Chinese Debt-trap?

Looking at the recent news coming from south-east Asia, questions are being raised on the events taking place in the region. Bangladesh, for example, has reportedly received huge loans from China for infrastructure development. Experts say this is a debt-trap, used under a policy by China's communist government to gain political influence and control over foreign territories. Many countries are already in Chinese debt-trap and unwillingly handing over the strategic ports to China.

Which countries are victims of Chinese debt-trap?

As per the analysis of recent years, there are almost 8 countries having huge debt from China in the name of investment and infrastructure development. They are Pakistan, Maldives, Tajikistan, Kyrgyzstan, Mongolia, Laos, Djibouti, and Montenegro.

Notably, China has already been developing and controlling Gwadar port of Pakistan, Hambantota port of Sri Lanka, and Kyaukpyu deep seaport of Myanmar. It had also offered Bangladesh a plan to develop Sonadia port in 2016. But Bangladesh rejected it by considering the same offer by India. However, recent news shows that Bangladesh is also going ahead to fall within the Chinese debt-trap.

Which countries are concerned?

Political analysts and economists, especially of USA and India, are seeing this as a threat to regional security and political stability.

China has been following a strategy called String of Pearls to make pressure on India. On the other hand, it’s trying to strengthen her stand and control over the South China Sea. The USA and South Asian countries like Vietnam, Philippines, Malaysia, and Indonesia are already involved in a dispute with China over the control of the South China Sea.

In this context, China’s political and economic strategy is considered as a threat to these countries.

How can this strategy pose a threat?

China slowly but steadily spreading her influence and reach in South-east Asia, South Asia, middle east, and south African countries. First, they give huge loans to these countries to help build infrastructures like roads and bridges, ports, and industrial zones, mostly with partnership contracts.

It also helps developing ports with a condition that such port will be under the control of China for certain years. Many ports are even taken on a long-lease and being developed. Sometimes, the small country is unable to manage large built-up like ports or fail to repay the loan and ultimately fall in the Chinese debt-trap. In this case, China demands partial or full control of such port.

Who can control China?

The biggest concern is that China can use these ports, bridges, and roads to mobilize its military and navy. Making political and military pressure on the rival countries like India, the USA, and Japan with this capacity will be easy for China. So these countries are taking it seriously and looking for ways to make a balance of power in strategic regions like the South China Sea and the Pacific ocean.

The USA has already been maintaining large military bases in South Korea and Japan compelling China to stay within limits. On the other hand, India has also developed a naval presence in Chabahar port of Iran and already having naval bases in Andaman Nicobar and Lakshadweep islands. India can easily keep an eye on Chinese movement and can have better control in war-like situations.

Chinese economic slowdown

Though China is trying to be a world power, its economy is going through the weakest periods in recent years. In the first quarter of 2019, its total debt has risen to 303 of GDP and Growth rate is around 6.2% which is the lowest of the past 20 years. Furthermore, a trade war with the USA and declining trust and interest from foreign investors are making the situation worse. The Chinese debt-trap is also known to small countries and hence avoiding it.

If China will not make good relationships with neighboring countries, it will surely see more difficulties and economic slowdown in the future. India - regional giant and superpower, the USA - world superpower, and Japan -a silent power are getting together to form a joint power to control the increasing threats from the dragon.

It’s clear that China is trying to create a new concept of power in the Pacific ocean territory and the South China Sea. However, it’s also facing tough counteractions from countries like India, the US, and Japan. Though some countries like Pakistan and Sri Lanka are neglecting possible threat from China, it is certain that they will soon see the consequences of being in the Chinese debt-trap. Needless to say that they will have no option but to look towards India or the USA for help in the future.

The Right to Justice: What We Took Away from Glenn Ford

Access to justice in Louisiana, especially for the minority or poor individuals, has been a problem for many years. Louisiana has regularly limited funding for public defenders and, as a result, has left thousands of people who are being or were sued without proper representation.

To try and lessen the judicial crowding, some areas have ordered non-criminal attorneys to represent the poor. At times, judges have called upon personal injury attorneys in Louisiana, or insurance or tax lawyers, to represent people in criminal trials, including murder crimes where the person being sued could face life in prison.

The Life and Death of Glenn Ford

In 1984, Glenn Ford was declared guilty for committing murder in Louisiana. Ford spent almost 30 years on death row, in Louisiana’s Angola prison, until new proof revealed in fact that he did not commit the crime. He was cleared from guilt in 2014, but sadly died of lung cancer approximately a year later.

In a 60 Minutes interview from 2015, Bill Whitaker spoke to the prosecutor who proved him guilty and sent Ford behind bars: Marty Stroud from Shreveport, Louisiana.

Stroud admits the cards were stacked against Ford from the very start; Ford’s court-selected attorneys had never practiced criminal law.

Stroud further acknowledged that “There were no African Americans on the jury. So, when Glenn Ford walks into that courtroom, he’s got a count of zero and two against him, and a fast ball’s coming right at his head for strike three.”

Ford was sent to one of the most infamous prisions in America, Angola, a maximum-security facility known for uncivil conditions, including summer temperatures that reached 104° Fahrenheit on the death row block.

Dale Cox, who is the current district attorney of Caddo Parish, states that Glenn Ford received a “delayed justice,” but justice nonetheless.

According to Cox, the fear of putting an innocent man to death is a risk all of us must be willing to take in order to secure peace and an effective criminal justice system.

Compensation for the Wrongfully Accused

Glenn Ford was qualified for by right according to law to a $330,000 compensation, for his wrongful judgement of guilt in court and mistreatment at Angola. However, the state is now denying Ford’s family the opportunity to receive that amount, after the Louisiana Supreme Court announced it would not consider the two lawsuits brought on by Ford’s family.

Last year, a state district judge ruled that Ford wasn’t eligible to receive payment because “the trial evidence showed that he was involved in lesser related crimes.”

More specifically, Ford is accused of knowing about the robbery of Shreveport jeweler,  Isadore Rozeman, was to take place and he didn't do anything to try and prevent it.

Louisiana's compensation law does not pay for anyone who did/perform any crimes based upon the same set of facts used in the original conviction, and allows a judge to consider any evidence regardless of whether it’s allowed or kept from the criminal trial.

In addition, people who are exonerated in Louisiana must prove that they are innocent in any related crimes in order to be paid. This is very different from states such as California, where the state pays without the need to prove one is innocent for any related crimes.

Ford was found to be someone who helped or knew about the armed robbery after the fact; he was also found to have stolen items that were taken from the same crime. Because of this, Ford’s 30 years on death row will not be paid.

Better Access to Justice

Louisiana Rep. Cedric Glover is trying to fight for better access to justice in cases similar to Ford’s. Cedric Glover is trying to change Louisiana’s current compensation legislation, and will bring his second attempt forward some time this year (the first attempt was not successful).

Andrea Armstrong, the person in charge for handlingFord’s estate, claims that this “is not the end of [Glenn’s] story…”

Having the right to justice is important to everyone in Louisiana, not just the wrongfully convicted. Everyone should have qualified representation, lest we forget what happened to Glenn Ford and his family.

If you have questions about obtaining access to justice, or a personal injury claim, we at the Monroe Law Office of J. Antonio Tramontana, Attorney at Law, want to hear from you.

China's Economic Slowdown and the Reasons

China's Economic Slowdown and the Reasons

Chinese president Xi Jinping admitted that China's economic slowdown will be even more visible in the coming years. Experts say that it will not achieve 6.5% target due to debt and liquidity crisis. The picture of booming economy and future's apparently rich society has been turning into an unreachable goal for coming years. This is happening due to the devaluation, overwhelming growth of towns which are unable to attract people of China who can't actually afford it, high debt and growing heavy burden of repayment.

Apart from these main reasons, below are some reasons which, if not directly, are causing China's economic slowdown.

Low-quality products

Chinese products exported to other countries are generally of low quality and sometimes harmful to the users, especially the toys for children. As a result, some countries have started banning some Chinese products to protect their citizen's health. The plastic, rubber, and colors used to make Chinese toys are generally of low quality and harmful for the health of children and are of concern for the developed countries of Europe and America.

On the other hand, the labor in China is also getting affected by the low-quality raw material used to manufacture the products. This is another reason why governments and importers of the western world have started to ban such products. This is resulting in huge losses to the manufacturing sector and ultimately China's economic slowdown. China has to control the unethical practices in manufacturing unites to regain the trust of importing countries to stop further loss. China needs to overcome the greed of bringing foreign currency into the country by controlling such unethical manufacturing companies.

Dumping of low-quality products

China has been resorting to the way of dumping cheap and low-quality goods in developing countries. All its government wants to do is to keep their manufacturing units running and has been doing this for the last few decades. This has created a protest from commerce associations of many countries. They are demanding the steps to curb the dumping. Governments of many countries have started implying anti-dumping duty as protective measures to enable local industries to compete with cheap Chinese goods. This is affecting the manufacturing sector and threatening its position as a manufacturing hub of the world which is one of the many signs of China's economic slowdown.

Territory and border disputes

China has disputes with almost all of its neighbors over borders and territory. This, especially the disputes for the control on areas of the South China Sea has prompted opposite moves among countries involved in a dispute with China. They are increasing the trade and defense co-operation to counter the increasing influence of China as an economic and military power. Japan-US, Japan-India and India-US relations and agreements on trade and defense are a few examples.

People of South Asian countries like India, Philippines, and Vietnam are now protesting and asking for the boycott of the use of Chinese products.

Small countries like Pakistan, Maldives, Tajikistan, Kyrgyzstan, Mongolia, Laos, Djibouti, and Montenegro are becoming the victims of the Chinese debt-trap. But their citizens will start protesting China in the future when they will realize this country's motives and strategy. This may further worsen the situation causing China's economic slowdown rapid.

Possible solutions for China's economic slowdown

To overcome this situation, China needs to resolve disputes with neighbors and live peacefully. But the government seems unwilling for this as it's seeing China as a more powerful and influencing country compared to those around it, ignoring the principles of peaceful coexistence and mutual development. Unfortunately, the Chinese government is also ignoring the fact that it can't create a sustainable future by following unfair ways of making wealth. Sooner or later, the bubble of Chinese booming economy will be burst.

Implied Powers of the President of the United States

Implied Powers of the President of the United States

The Constitution gives power to Congress to declare war as a check on Presidential power. However, he inherits the authority to use troops if he encounters an immediate threat to the United States and Congress does not have the opportunity or the time to declare war. So, how does one amend the parameters to limit him? What sort of threats is so immediate and dangerous that the President should find the need to use force?

Commander-in-chief in recent history

If one looks at recent history when America has sent troops to the conflict, especially during the 20th and the 21st centuries. It has been done with him acting as the commander in chief without a formal declaration of war from the Congress. Examples include: Korea (1950 - 1953), Vietnam( 1955-1975), Iraq(1990-91) and (2003-11).

After Vietnam, Congress tried to put the brakes on passing the war power resolution, which required the President of the United States to get authorization to use troops within 60 days of their commitment. He is advised to bring them back in case the authorization fails. However, in practice, Congress almost always formally approves his power to use force.

Treaties and agreements

As a diplomatic stance, the constitution officially allows the President to make treaties, receive and appoint ambassadors and ministers.

The President has developed the power to negotiate Executive Agreements as well.

The most important difference between an Executive Agreement and a Treaty is that an agreement doesn't need to be ratified by two-thirds of the Senate and is valid with only a majority vote in both houses.

The President is the CEO of the United States

Although it isn't mentioned in the constitution, the President is the chief executive officer or the CEO of the United States. Formally it is in the faithfully executed clause of the Presidential oath of office, but more importantly comes from his power to appoint judges, ambassadors, and other ministers.

The President chooses administrative heads that agree with his policies. His appointments shape political agenda, where he assumes the inherent power to direct the ministers and their agencies on how to implement laws. Enabling him to address the way the government acts.

The President can attempt to set the legislative agenda by making recommendations for laws he'd like to see passed. This is called the legislative initiative and in practice usually involves the executive branch drafting legislation to the Congress which is refined to make it pass. This happens with big agenda items like the affordable care act, also known as the Obama care act or the Dodd-Frank act which despite being named after its two congressional sponsors was written with input from the white house. One should also note that Congress often willingly gives power to the president of the United States to avoid responsibilities on traditional policies.

Another legislative authority and probably the most important one:

He can give Executive orders. These are Presidential directives or rules that have the force of law. Executive orders can be overturned by actual congressional lawmaking or by the decision of the supreme court.  Executive orders allow the President to circumvent the legislative process and act unilaterally. Ideally, the President and Congress work together.

Executive orders may not be as durable as the laws passed through normal channels if the next President in office disagrees with the order of the United States president. He or she can get rid of them just as easily as his/her Predecessor put them a place.

The President can impound funds the Congress has appointed to individual programs or projects if he doesn't want them implemented.

The ultimate inherent power of the President is Executive Privilege. This is the President's ability to keep information secret by claiming that it is too important to be revealed,  usually for reasons of national security. The Executive Privilege can, however, be overturned by a court order.

The Powers of The President of The United States Of America; the commander in chief of the world's strongest army!

The president of the United States is elected through an electoral vote. The electors are representatives from various districts who win by a majority of the popular vote. Each state, with respect to its population, is divided into different districts, e.g., New York: 29, California: 55; the number of electoral votes is 538, corresponding to the total number of districts in the country.

A candidate wins a presidential election by a majority of 271 votes or more.

It’s important to learn the power a President inherits when he is elected to office. The choice of a preferred candidate decides the fate of the country and the world in general. Resources at his disposal are of appropriate notice to a citizen which are inherited as privileges on being elected as the first citizen of the country.

His formal powers defined by the Constitution include:

a) He is the Commander in Chief of the Armed Forces

b) He is the Country's Chief Diplomat: The President does not conduct most of the diplomacy, but appoints ambassadors in State Department officials. He is assigned the power to make treaties mostly written by those officials.

The President can also legitimize a nation state when he receives an ambassador of a country.

c) The Constitution requires the President to inform Congress of the State of The Union which takes the form of an annual state of the union address, which is a chance for the President to set a policy agenda for the next year, putting pressure on the Congress.

d) The president has a formal legislative power to veto laws passed by the Congress and to convene Congress into special sessions.(Veto is the power to stop the enactment of legislation unilaterally)

e) Judicial powers enable him to appoints judges with the consent of the Senate.

f)  The power to grant pardons and reprieves when imprisoned or threatened with a criminal prosecution.

The framers of the constitution wanted a limited government, one who couldn't oppress the people. Afraid of a high executive like a king, they deliberately curtailed his powers by not giving him many.

However, over a period two centuries(240 years or so) the powers of the President have expanded far beyond what the framers had envisioned.

His informal powers are either considered inherent to his office or implied by the written text of the constitution.
